These Terms of Service (“Terms”) govern your access to and use of bougiecattlecompany.com, including our online store, booking pages, ranch experiences, livestock listings, live streams, events, forms, customer communications, email and SMS programs, and any related products or services.
By visiting our website, making a purchase, booking an experience, submitting a form, signing up for email or SMS messages, attending an event, participating in a ranch experience, viewing a livestream, or otherwise using our services, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use our website, purchase products, book experiences, or use our services.

1. Eligibility
By using our website or services, you represent that you are at least the age of majority in your state or province of residence, or that you are using the website with the consent and supervision of a parent or legal guardian.
Minors may not make purchases, book ranch experiences, sign waivers, purchase livestock, or enter into agreements with Bougie Cattle Company without a parent, guardian, or authorized adult.
2. Online Store Terms
You agree not to use our products, services, website, content, or communications for any unlawful, unauthorized, fraudulent, harmful, or prohibited purpose.
You may not:
- Violate any applicable law or regulation
- Use the website to transmit viruses, malware, or harmful code
- Attempt to interfere with the security or operation of the website
- Misrepresent your identity or payment information
- Use our content, photos, videos, copy, branding, or materials without permission
- Harass, abuse, threaten, defame, or harm Bougie Cattle Company, our team, our customers, or others
- Scrape, copy, harvest, or collect information from the website without authorization
- Use our website or services in a way that could damage our business, animals, reputation, systems, or customers
We reserve the right to refuse service, cancel orders, cancel bookings, deny entry, remove guests, restrict account access, or terminate use of our services for any reason permitted by law.
3. Products, Services, and Availability
Products, ranch experiences, livestock listings, events, live streams, appointments, and services may be available in limited quantities and may change at any time without notice.
We reserve the right to:
- Modify or discontinue products or services
- Limit quantities
- Refuse or cancel orders
- Correct errors or inaccuracies
- Change pricing
- Update descriptions, availability, and booking options
- Restrict sales to any person, region, or jurisdiction where permitted by law
We make reasonable efforts to display accurate product, service, livestock, booking, and event information. However, we do not guarantee that all descriptions, pricing, images, videos, availability, colors, sizes, dates, or other content will always be accurate, complete, current, or error-free.
4. Pricing, Payments, Deposits, and Balances
All prices are listed in U.S. dollars unless otherwise stated.
Prices are subject to change without notice. We reserve the right to correct pricing errors, including after an order or booking has been submitted. If an error affects your order, we may contact you for instructions or cancel the order and issue a refund where appropriate.
Certain products, livestock purchases, events, ranch experiences, or bookings may require a deposit, partial payment, installment payment, or remaining balance. By submitting payment information, you authorize us and our payment processors to charge the payment method provided for the agreed amount.
Deposits may be non-refundable unless otherwise stated in writing. Remaining balances must be paid according to the applicable listing, invoice, agreement, or policy.

5. Orders, Booking Confirmations, and Account Information
You agree to provide accurate, complete, and current information for all purchases, bookings, livestock inquiries, account registrations, forms, and communications.
We are not responsible for delays, missed communications, failed deliveries, booking issues, or order problems caused by inaccurate or incomplete information provided by you.
An order confirmation, booking confirmation, invoice, or automated message does not guarantee acceptance of an order or booking. We reserve the right to review, refuse, cancel, modify, or limit any order or booking where permitted by law.
6. Ranch Tours, Experiences, and Events
Bougie Cattle Company offers ranch-related experiences that may include tours, calf cuddling, bottle feeding, animal encounters, lunch tours, private events, event rentals, photography opportunities, livestreams, and other in-person or online experiences.
By booking, attending, or participating in any ranch experience, you acknowledge that ranch environments and live animal interactions involve inherent risks, including but not limited to uneven ground, weather, dust, insects, equipment, gates, fences, livestock, animal movement, bites, kicks, scratches, allergic reactions, slips, falls, and other hazards.
You agree to follow all posted rules, verbal instructions, safety guidelines, age requirements, arrival instructions, parking instructions, and animal-handling rules.
Bougie Cattle Company reserves the right to deny entry, end participation, remove guests, or cancel an experience if a guest behaves unsafely, fails to follow instructions, appears impaired, harasses animals or staff, damages property, violates policies, or creates a risk to themselves, others, our animals, or our property.

7. Live Animals and Animal-Related Experiences
Our services may involve live animals, including but not limited to calves, cattle, horses, donkeys, goats, camels, zebras, llamas, and other animals.
Animals are unpredictable by nature. We make reasonable efforts to maintain a safe and enjoyable environment, but we cannot guarantee animal behavior, guest reactions, weather conditions, ranch conditions, photo outcomes, or a completely risk-free experience.
Guests are responsible for supervising children and following all instructions around animals. Unless expressly permitted in writing, guests may not feed, touch, enter pens, open gates, approach animals, or interact with animals without Bougie Cattle Company staff approval.
8. Livestock Sales and Purchases
Livestock listings, deposits, purchases, auctions, availability, pricing, health information, transport, pickup, and related terms may be subject to additional written terms.
Unless otherwise stated in writing, livestock deposits are used to reserve a specific animal or purchase opportunity and may be non-refundable.
Livestock are living animals, and availability, health, condition, temperament, appearance, size, color, registration status, genetics, pregnancy status, delivery timing, and other factors may change. We make reasonable efforts to provide accurate information, but no guarantee is made unless expressly provided in a written agreement signed or confirmed by Bougie Cattle Company.
Buyers are responsible for understanding all responsibilities related to livestock ownership, including transport, care, feeding, fencing, veterinary care, registration, insurance, local laws, and ongoing costs.
Please review our Livestock Purchase Terms, and any invoice, listing, auction terms, bill of sale, or written agreement applicable to your purchase.
9. Auctions and Third-Party Sales Platforms
We may use third-party platforms, including auction, booking, payment, livestream, CRM, email, SMS, and ecommerce tools, to operate parts of our business.
If you use a third-party platform, you may also be subject to that platform’s own terms, privacy policy, fees, payment rules, dispute processes, and account requirements.
We are not responsible for third-party platform outages, errors, delays, payment issues, bidding errors, failed notifications, technical problems, security incidents, or policy changes, except where required by law.
10. Refunds, Cancellations, Rescheduling, and Weather
Refunds, cancellations, rescheduling, no-shows, deposits, weather-related changes, late arrivals, event changes, and livestock-related payments are governed by the applicable product description, booking page, invoice, written agreement, and our Refund, Cancellation & Deposit Policy.
Because ranch experiences, livestock, events, and appointments require scheduling, staffing, animal preparation, and limited availability, certain payments may be non-refundable or subject to rescheduling limitations.
We reserve the right to cancel, reschedule, modify, or relocate ranch experiences, events, bookings, or services due to weather, animal health, safety concerns, staffing issues, property conditions, emergencies, force majeure events, or other circumstances beyond our control.
11. Email Communications
By providing your email address, creating an account, making a purchase, booking an experience, submitting a form, or otherwise communicating with us, you agree that we may send you transactional, service-related, and, where permitted, marketing emails.
Emails may include:
- Order confirmations
- Booking confirmations
- Payment reminders
- Deposit or balance notices
- Shipping or delivery updates
- Customer service responses
- Abandoned cart reminders
- Product updates
- Ranch updates
- Event announcements
- Livestock updates
- Promotional offers
- Policy updates
You may unsubscribe from marketing emails by clicking the unsubscribe link in our marketing emails or contacting us directly. Even if you unsubscribe from marketing emails, we may still send transactional or service-related emails related to purchases, bookings, payments, customer support, livestock transactions, or legal/policy notices.
12. SMS/MMS Text Messaging Terms
By providing your mobile phone number and opting in to receive text messages from Bougie Cattle Company, you consent to receive SMS and/or MMS messages from us, including messages sent using automated technology.
Messages may be sent through platforms such as Shopify, GoHighLevel, Klaviyo, Postscript, Attentive, or other SMS/MMS service providers.
Messages may include:
- Order confirmations
- Booking confirmations
- Appointment or event reminders
- Delivery, pickup, or service updates
- Customer service messages
- Payment, deposit, installment, or balance reminders
- Ranch announcements
- Product launches
- Livestock updates
- Cart reminders
- Review requests
- Promotional offers
- Marketing messages
Consent to receive marketing text messages is not required as a condition of purchase.
Message frequency may vary. Message and data rates may apply.
You may opt out of marketing text messages at any time by replying STOP to a text message from us. You may also contact us at jo@bougiecattleco.com or (760) 528-8778 to request that we stop sending marketing text messages.
After opting out of marketing text messages, you may still receive transactional or service-related messages where permitted by law, such as messages about an existing order, booking, payment, delivery, pickup, livestock purchase, or customer service request.

Wireless carriers are not responsible for delayed or undelivered messages.
We do not sell your phone number, SMS opt-in data, SMS consent status, or SMS message content to third parties for their own independent marketing purposes.

13. Third-Party Tools, Apps, and Services
We use third-party tools, apps, and platforms to operate our business, website, ecommerce store, booking system, CRM, forms, payments, shipping, email, SMS, ads, analytics, livestreams, customer support, session recording, heatmaps, auctions, and other services.
These may include Shopify, GoHighLevel, Easy Appointment Booking/Servicify, Klaviyo, Meta, Google, TikTok, Pinterest, Microsoft Clarity, Hotjar, Lucky Orange, payment processors, shipping providers, auction platforms, livestream tools, and similar providers.
You acknowledge that third-party tools may be provided “as is” and “as available.” We are not responsible for third-party outages, interruptions, data practices, errors, performance, or security issues, except where required by law.
Your use of third-party tools may be governed by their own terms and privacy policies.
14. Privacy and Data Use
Your submission of personal information through our website, store, booking tools, forms, email, SMS, livestreams, or other services is governed by our Privacy Policy.
We may use cookies, pixels, analytics tools, advertising tools, session recording, heatmap tools, and similar technologies as described in our Privacy Policy and Cookie Policy.
California consumers may have additional privacy rights as described in our Privacy Policy. California privacy law gives covered consumers rights including access, deletion, correction, and opt-out of sale or sharing of personal information.
15. User Content, Reviews, Photos, Videos, and Social Media
If you submit, upload, tag, post, send, or otherwise provide reviews, testimonials, photos, videos, comments, messages, social media tags, livestream interactions, or other content involving Bougie Cattle Company, our products, our animals, our ranch, our events, or our services, you grant Bougie Cattle Company a non-exclusive, royalty-free, worldwide license to use, reproduce, edit, publish, display, repost, distribute, and create derivative works from that content for marketing, advertising, social media, website, promotional, operational, and business purposes, where permitted by law.
You represent that you own or have permission to share the content and that it does not violate the rights of any other person, including privacy, publicity, copyright, trademark, or other rights.
Do not submit content involving minors unless you are the parent/legal guardian or have appropriate permission.
16. Photography, Video, Livestreams, and Media Release
By attending Bougie Cattle Company ranch experiences, events, tours, or live-recorded areas, you acknowledge that photography, video, audio, livestreams, security footage, or other recordings may occur.
To the extent permitted by law, you authorize Bougie Cattle Company to use photos, videos, audio, testimonials, livestream footage, or other media that include your image, likeness, voice, statements, or participation for marketing, social media, website, promotional, archival, security, training, and business purposes without additional compensation.
If you do not want to be photographed or recorded for marketing purposes, please notify Bougie Cattle Company in writing before the event or experience begins. We will make reasonable efforts to honor such requests, but we cannot guarantee exclusion from crowd shots, public event footage, security footage, livestream backgrounds, or incidental appearances.
17. Intellectual Property
All website content, branding, logos, photos, videos, copy, graphics, product names, service names, designs, layouts, digital materials, and other content owned by Bougie Cattle Company are protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, sell, exploit, scrape, download, repost, or use our content without prior written permission, except for personal, non-commercial use related to browsing or purchasing from our website.
18. Accuracy of Information
We do our best to provide accurate and current information, but we do not warrant that website content, product descriptions, livestock details, pricing, availability, images, videos, dates, times, or service descriptions are accurate, complete, reliable, current, or error-free.
Any reliance on website materials is at your own risk.
19. Health, Safety, and Guest Responsibility
Guests are responsible for their own safety and the safety of minors or dependents in their care.
You agree to:
- Wear appropriate clothing and footwear
- Follow all staff instructions
- Respect animals and property
- Supervise children at all times
- Stay in permitted areas
- Avoid entering pens, barns, gates, or restricted areas without permission
- Avoid touching, feeding, or approaching animals without staff approval
- Notify staff of any safety concern, allergy, injury, or emergency
- Follow all posted and communicated rules
Bougie Cattle Company may refuse participation or remove any guest who fails to comply.
20. Assumption of Risk
To the fullest extent permitted by law, by attending or participating in ranch visits, animal encounters, tours, events, livestreams, livestock-related activities, or other Bougie Cattle Company experiences, you voluntarily assume all risks associated with those activities.
These risks may include injury, illness, allergic reactions, property damage, weather exposure, slips, falls, animal-related incidents, emotional distress, and other risks inherent to ranch, farm, livestock, and event environments.
Nothing in these Terms limits liability that cannot be limited under applicable law.
21. Disclaimer of Warranties
Our website, products, services, content, third-party tools, livestreams, booking systems, and communications are provided “as is” and “as available” unless otherwise stated in writing.
We do not guarantee that:
- The website or services will be uninterrupted, timely, secure, or error-free
- Errors will be corrected
- Products, livestock, or services will meet your expectations
- Animal behavior, appearance, temperament, or outcomes will be predictable
- Booking, payment, email, SMS, livestream, or third-party tools will always work without interruption
- Website content will always be accurate, complete, or current
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
22. Limitation of Liability
To the fullest extent permitted by law, Bougie Cattle Company, its owners, employees, contractors, agents, vendors, partners, affiliates, and service providers shall not be liable for any indirect, incidental, punitive, special, consequential, or exemplary damages, including lost profits, lost revenue, lost savings, loss of data, injury, property damage, or other damages arising from or related to your use of our website, products, services, bookings, events, ranch experiences, livestreams, livestock purchases, third-party tools, or these Terms.
To the fullest extent permitted by law, our total liability for any claim related to the website, products, services, bookings, events, ranch experiences, livestock transactions, or these Terms shall not exceed the amount you paid to Bougie Cattle Company for the specific product or service giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
23. Indemnification
You agree to indemnify, defend, and hold harmless Bougie Cattle Company, its owners, employees, contractors, agents, vendors, affiliates, partners, and service providers from and against any claims, damages, liabilities, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your breach of these Terms
- Your violation of any law or third-party right
- Your misuse of our website, products, services, animals, property, or content
- Your participation in ranch experiences, events, livestock-related activities, or bookings
- Your user content, photos, videos, reviews, posts, or submissions
- Your inaccurate information, payment disputes, or unauthorized transactions
- Your failure to follow safety rules, staff instructions, or posted policies
24. Force Majeure
Bougie Cattle Company shall not be liable for delays, cancellations, interruptions, or failure to perform caused by events beyond our reasonable control, including weather, fire, flood, natural disasters, illness, animal health issues, veterinary emergencies, labor shortages, power outages, internet outages, platform outages, payment processor issues, carrier delays, government actions, war, terrorism, accidents, supply shortages, or other events beyond our control.
25. Automatic Renewals, Memberships, and Recurring Services
If Bougie Cattle Company offers memberships, subscriptions, livestream access, recurring services, automatic renewals, installment plans, or recurring billing, the specific terms will be disclosed at checkout or sign-up.
By enrolling in a recurring service, you authorize us and our payment processors to charge your payment method at the disclosed frequency and amount until canceled according to the applicable terms.
California’s automatic renewal rules require clear renewal disclosures, affirmative consent, and cancellation processes for covered recurring services, so any future memberships or subscriptions should have a separate checkout disclosure and easy cancellation process.
26. Errors, Inaccuracies, and Omissions
Occasionally there may be information on our website or in our services that contains typographical errors, inaccuracies, or omissions related to product descriptions, livestock details, pricing, promotions, offers, shipping charges, transit times, booking availability, event dates, or other information.
We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders or bookings if any information is inaccurate at any time without prior notice, including after you have submitted an order or booking.
27. Governing Law
These Terms and any disputes arising out of or related to these Terms, our website, products, services, bookings, ranch experiences, events, livestreams, or livestock transactions shall be governed by the laws of the State of California, without regard to conflict of law principles.
28. Dispute Resolution
Before filing any legal claim, you agree to first contact us at jo@bougiecattleco.com so we can attempt to resolve the issue informally.
Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in California, unless otherwise required by applicable law or agreed in writing.
29. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
30. No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
31. Termination
We may suspend or terminate your access to our website, services, bookings, communications, or accounts at any time if we believe you violated these Terms, created a safety risk, engaged in fraudulent activity, abused our services, or violated applicable law.
You may stop using our website and services at any time.
32. Changes to These Terms
We may update, modify, or replace these Terms at any time by posting the revised version on this page with an updated “Last updated” date.
Your continued use of our website, products, services, bookings, or communications after changes are posted means you accept the updated Terms.
